Please answer the following questions in 200 words or more. Place the essay answer in the submission box as a single Word Doc by Sunday at 11:59 a.m. Copyright, one of the 4 classes of intellectual property, protects the expression of an idea, not the idea itself. Thus, song lyrics are capable of copyright because it is the expression of an idea. However, each version of those lyrics, acoustic, electronic, etc., has its own copyright and is also protected under the lyrics themselves. Certain artists are highly protective of their work as original art and will not allow any unauthorized use without permission. Artists such as Prince, Bob Dylan, the Beatles, Metallica, and others are well-known for their propensity for issuing “cease and desist” letters for unauthorized use and will take action without hesitation for failing to comply with the cease and desist notice. The Beastie Boys are arguably the most litigious of all music groups. The late MCA, who died in 2012, stated in his will that he wished that no Beastie Boys music is ever to be used in a commercial. What are the issues in the below case? What argument do the Beastie Boys make regarding licensing? https://digitalcommons.law.scu.edu/cgi/viewcontent.cgi?referer=https://www.google.com/&httpsredir=1&article=1555&context=historical
Keep the following in mind when drafting your essay:
1) When addressing legal opinions, use the IRAC method. IRAC stands for Issue, Rules, Analysis (sometimes referred to as application), Conclusion. Discussing an opinion using an IRAC will ensure that you address the relevant aspects of each opinion. 2) Write the essay in a manner where it is clear you understand the concept. Repeating concepts from the text does not illustrate to me that you understand the material. The best essays will include an example or illustration of the concept discussed.
3) NO PLAGIARISM! Remember that, even when discussing case law or information from the text book, you must quote and cite any material taken directly from the case. As a general rule, keep quotations to 10% or less and paraphrase all other relevant information.
